Expertise in party wall matters

The Party Wall etc. Act 1996 was designed to protect property owners involved in or affected by neighbouring building work. Originating from the successful ‘London Building Acts,’ this legislation was extended to cover the rest of England and Wales. The Act outlines the rights and responsibilities of property owners, ensuring that any building work near a boundary line is conducted fairly and without causing undue harm to adjacent properties.

Our role as party wall surveyors is to meticulously assess proposed works, ensuring that they are designed and executed to prevent damage to adjoining buildings or property. In the rare event that damage does occur, our surveyors are equipped to award damages, providing protection to the affected property owners.

Party wall services:

  • Notice serving – We assist building owners in serving formal notices to adjoining property owners before commencing work, as required by the Party Wall Act. This notice is crucial for maintaining transparency and ensuring all parties are informed of the planned works
  • Award negotiation – The Act often requires a formal agreement, known as an “Award,” to be reached before any building work begins. Our surveyors are skilled in negotiating these conditions professionally and reasonably, helping to avoid conflicts and ensuring that both parties’ interests are respected
  • Access rights management – The Party Wall Act grants rights of access to surveyors and building owners for inspections, scaffolding erection, and other necessary activities on adjoining land. We manage these rights carefully, ensuring that the work can proceed without unnecessary delays or disputes
